This Federal Firearms Licensee (FFL) Compliance Policy outlines the requirements, procedures, and responsibilities for customers and designated FFLs to facilitate legal and secure firearm transactions through our platform. Adherence to these guidelines is mandatory to maintain the integrity of our operations and protect all parties involved.

What is an FFL?

A Federal Firearms Licensee (FFL) is a business or individual authorized by the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) to engage in the manufacture, importation, or sale of firearms and ammunition. Under the Gun Control Act of 1968, all firearm transfers, with few exceptions, must be conducted through a licensed FFL to ensure proper background checks and record-keeping.

FFL Requirements for Purchases

• Mandatory FFL Transfer: All firearms purchased from Gunzest, including handguns, rifles, and shotguns, must be shipped to a licensed FFL for transfer to the end customer. This applies to both in-state and out-of-state transactions.
• Customer Responsibility: Customers are required to:
  • Provide the name, physical address, and valid FFL number of their chosen licensee at the time of checkout.
  • Verify that the designated FFL is willing to accept the transfer and comply with local laws.
  • Cover any transfer fees charged by the FFL, which typically range from $20.00 to $50.00, depending on the licensee.
• Age Restrictions: Customers must be at least 21 years old to purchase handguns or handgun ammunition, and 18 years old for long guns and rifle ammunition, as mandated by federal law.

FFL Verification Process

• Initial Verification: Upon receiving an order, Gunzest will contact the provided FFL to confirm their license status and willingness to accept the shipment. This process may include verifying the FFL number against the ATF’s database.
• Communication: Customers will be notified via email if the FFL cannot be reached or declines the transfer. In such cases, an alternative FFL must be designated within 48 hours, or the order will be canceled.
• Documentation: The FFL must provide a copy of their current license (either via email or fax) if requested by Gunzest to complete the verification process.

Shipping and Transfer Procedures

• Shipment to FFL: Firearms are shipped only to the physical address of the verified FFL, not to P.O. boxes or residential addresses. Shipments require an adult signature (21 or older) and are insured against loss or damage.
• Background Check: Upon receipt, the FFL will conduct a National Instant Criminal Background Check System (NICS) or equivalent state check to ensure the customer is eligible to receive the firearm. This process may take a few minutes or up to several days, depending on local procedures.
• ATF Form 4473: The FFL must complete and retain ATF Form 4473, which the customer must fill out accurately. Any discrepancies or denials must be reported to Gunzest within 24 hours.
• Transfer Completion: Once the background check is approved, the FFL will transfer the firearm to the customer. Gunzest is not responsible for delays caused by FFL processing or local regulations.

Compliance with State and Local Laws

• State-Specific Restrictions: Gunzest adheres to varying state laws, such as magazine capacity limits (e.g., 10 rounds in California) and prohibited firearms (e.g., assault weapons in New York). Customers must ensure compliance with their state’s regulations, and Gunzest reserves the right to cancel orders that violate these laws.
• Prohibited Areas: Shipments are not made to jurisdictions with strict firearm bans (e.g., Washington, D.C.) or to individuals on prohibited purchaser lists. Customers are responsible for confirming eligibility.
• Ammunition Restrictions: Ammunition shipments may be restricted or prohibited in certain states (e.g., Illinois, Massachusetts). Gunzest will notify customers of any limitations at checkout.

FFL Responsibilities

• License Maintenance: The FFL must maintain a current and valid license with the ATF. Expired or revoked licenses will result in shipment delays or order cancellation.
• Record-Keeping: The FFL is required to log the transaction in their Acquisition and Disposition (A&D) book and retain records as mandated by federal law.
• Inspection: Upon delivery, the FFL must inspect the package for damage and report any issues to Gunzest and the carrier within 24 hours to initiate a claim.

Customer Responsibilities

• Accurate Information: Customers must provide correct FFL details and update Gunzest if changes occur. Providing false information may result in order cancellation and legal action.
• Timely Action: Customers must complete the FFL transfer within 30 days of shipment. Unclaimed packages may incur storage fees or be returned to Gunzest, with associated costs borne by the customer.
• Legal Compliance: Customers are solely responsible for adhering to all applicable laws, including possession and carry permits, after the transfer.

Non-Compliance Consequences

• Order Cancellation: Gunzest reserves the right to cancel orders if the FFL cannot be verified, local laws are violated, or payment issues arise.
• Legal Action: Providing false information or attempting to circumvent FFL requirements may lead to account suspension and reporting to the ATF.
• Refunds: Canceled orders due to non-compliance are subject to a 15% restocking fee, with original shipping costs non-refundable.
